Submission of GML 239 Referrals
GML-239 referrals should be submitted to County Planning from the municipal board considering the proposed action. We will accept materials from an applicant only at the specific direction of the municipality. Referrals should be sent electronically to planning@sullivanny.us.
Submit a “Full Statement,” including:
- A fully completed County Referral form. Please use the fillable PDF provided below. Clicking on the outlined 'Submit Full Statement' box at the bottom of the form will generate an automatic email to the planning@sullivanny.us address.
- Completed Environmental Assessment Form, or EIS if applicable
- Any and all other materials the reviewing board has on the action including, but not limited to, site plans, elevations and renderings, subdivision plans, local laws, project narrative, balancing test for granting variances, etc.
- If you do not have digital copies of the documents, the applicant or the applicant’s consultant may be able to provide them. PDFs are preferred to document scans.
- If the digital files are too large to be transmitted in a single email, you may send them in multiple emails or use a cloud-based service such as WeTransfer or Dropbox.
- For projects in or near one of the County’s two agricultural districts, include a completed Agricultural Data Statement. That form is also below.

Consider an Exemption Agreement. In 2019 the Sullivan County legislature authorized intermunicipal agreements to exempt certain actions of strictly local concern from GML-239 review in order to streamline the development review process and enable more efficient and productive use of both County and municipal staff time. The approved template is attached to consider if your municipality has not entered into such an exemption agreement.

Municipal Training Model Ordinance
According to New York State Law, members of municipal Planning Boards and Zoning Boards of Appeals must complete a minimum of four (4) hours of training on topics relevant to their respective roles as decision makers for their communities. The Town/Village Board is responsible for setting the parameters of what is considered acceptable training to receive credit.
